General Terms and Conditions

GENERAL INFORMATION

  • These General Terms and Conditions (hereinafter referred to as the “Terms and Conditions”) of the sole proprietorship Katrin König (hereinafter referred to as the “Photographer”), with its registered office at Májová 1477, 415 01 Teplice, ID: 19986122, registered in the Trade Register maintained by the Teplice Municipal Office, govern the mutual rights and obligations of the contracting parties arising in connection with or based on a contract or agreement for the provision of photographic services (hereinafter referred to as the “Contract”) concluded between the Photographer and the client (hereinafter also referred to as the “Client”) in accordance with the provisions of § 1751(1) of Act No. 89/2012 Coll., the Civil Code (hereinafter referred to as the “Civil Code”).
  • Provisions deviating from the Terms and Conditions may be agreed upon in the Contract. Deviating provisions in the Contract take precedence over the provisions of these Terms and Conditions.
  • The provisions of the Terms and Conditions are an integral part of the Contract concluded between the Photographer and the Client. The Client is sufficiently informed of these Terms and Conditions before placing an order and has the opportunity to familiarize themselves with them. By concluding the Contract, the Client further agrees that these Terms and Conditions become an integral part of the concluded Contract.
  • All contractual relationships between the Photographer and the Client are governed by the legal order of the Czech Republic. If the Client is a consumer, the relationships not governed by the Terms and Conditions are subject to the Civil Code and Act No. 634/1992 Coll., on Consumer Protection. If the Client is an entrepreneur, the relationships not governed by the Terms and Conditions are subject to the provisions of the Civil Code relating to entrepreneurs.

ORDERING PHOTOGRAPHIC SERVICES

  • Orders can be made through the contact form on the website, by email, via the Facebook page, or through Instagram.
  • The order becomes binding as soon as the shooting date is confirmed by both the Client and the Photographer.
  • By placing an order, the Client confirms acceptance and understanding of these Terms and Conditions, as well as understanding of the Photographer’s artistic approach and photographic style, and has no objections to them.
  • The order period depends on the Photographer’s current workload, and the order cannot be enforced in any way.
  • If the Client cannot attend the agreed-upon photo shoot for any reason and wishes to cancel or reschedule, they are required to notify the Photographer by phone or email with sufficient notice.
  • The Client acknowledges that if they request a rescheduled date, the nearest available date will be offered, considering the Photographer’s current booking schedule.
  • It may happen that no suitable date for the photo shoot is available, and this cannot be enforced in any way.

PRICE OF PHOTOGRAPHIC SERVICES

  • The prices for specific types of photo shoots are usually provided in the response to the inquiry.
  • Half of the price for the photo shoot is due on the day of the shoot.
  • The price for any additional products (photo canvases, photo books, or prints) must be paid via bank transfer before processing.
  • If the price for the photo shoot or any additional services beyond the package is not paid, the Photographer reserves the right not to deliver the order until it is fully paid.

PHOTOGRAPHY

  • All types of photo shoots are conducted only on the basis of a pre-agreed and confirmed appointment with the Client at a pre-arranged location.
  • The location for outdoor photo shoots is determined in agreement with the Photographer, and all types of offered photo shoots take place there.
  • In case of bad weather, the outdoor photo shoot will be rescheduled.
  • The duration of the shoot is individual and varies depending on the type of shoot.
  • Late arrival of the Client is not a reason to extend the shooting schedule.
  • If the Client is more than 20 minutes late without prior notice, the Photographer is entitled to cancel the shoot and leave the agreed location.
  • During the entire photo shoot, it is prohibited to make any recordings, whether photos or videos, without the Photographer’s consent.

DELIVERY OF PHOTOGRAPHS

  • The delivery time for photographs is up to 30 working days from the date of the shoot and depends on the type of shoot.
  • In case of unforeseen circumstances, the Photographer reserves the right to extend this period by 1 month.
  • The completed order will be delivered to the Client in electronic form via an online gallery to their email address.

PHOTO PROCESSING

  • The processed photographs will be delivered in the agreed scope in JPG format and in a 2:3 aspect ratio at the highest possible resolution (suitable for large-format printing).

UNEDITED PHOTOGRAPHS WILL NOT BE PROVIDED

  • The following adjustments are included in the price: cropping, exposure balance, contrast, brightness, color correction, and removal of temporary flaws such as pimples, small bruises, scratches, etc.
  • Special requests for more demanding retouching (e.g., wrinkle removal, taming of unruly hair, teeth whitening, removal of tattoos on children, visible straps, slimming, etc.) are possible by agreement with the Photographer for an additional fee of 150 CZK per photo, provided that the requested adjustment is feasible.
  • Dissatisfaction with one’s appearance is not a reason for a complaint about the photographs.

PHOTO DEVELOPMENT, PRINTING, COMPLAINTS

  • The photos are developed by verified suppliers.
  • Complaints about printed photos are only possible based on visible printing errors (scratches, streaks, and other visible defects), not based on color or brightness/darkness of the print.
  • Dissatisfaction and disagreement with the Photographer’s style and artistic approach are not grounds for a complaint about the order.

ARCHIVING OF PHOTOGRAPHS

  • All unedited photographs (RAW formats) are archived for 1 month from the delivery of the order, after which the data will be deleted in accordance with EU Regulation 2016/679 on the protection of individuals (GDPR).
  • If the Client wishes to make a complaint, they must do so within this period.
  • The delivered photographs (JPG formats) are archived for one year, in the case of wedding orders, for six months from the delivery.

CONSENT TO THE USE OF PHOTOGRAPHS

  • All published photographs in the portfolio, on social networks, or on the website have the consent of the individuals depicted. If the Client changes their mind, they have the right to withdraw their consent in writing or by email.

COPYRIGHT

  • All photographs are subject to copyright and are the property of the Photographer and may not be used for any commercial purpose, promotion, or sale to third parties without the written consent of the author. The photographed individuals may use the photographs for their non-commercial personal presentation.
